Welcome to LoanBase. These Terms of Service ("Terms") govern your use of the LoanBase mobile application ("App") and the services provided by COSTECH PRIDE TECHNOLOGY LIMITED ("we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use our services.

1. Acceptance of Terms

By using the LoanBase App, you confirm that you have read, understood, and agree to these Terms. These Terms constitute a legally binding agreement between you and COSTECH PRIDE TECHNOLOGY LIMITED.

2. User Eligibility

To use LoanBase, you must:

• Be at least 18 years of age.
• Comply with the "Know Your Customer" (KYC) requirements as mandated by Ghanaian financial regulations.
• Provide accurate, complete, and up-to-date information during the registration and loan application processes.

3. Description of Services

LoanBase provides personal credit loan services through our mobile application. These services are subject to these Terms, our Privacy Policy, and all applicable laws and regulations of Ghana.

4. User Responsibilities

You agree to:

• Provide accurate, complete, and truthful information when using the App, including during KYC verification and loan application processes.
• Maintain the confidentiality and security of your account credentials and notify us immediately if you discover any unauthorized use of your account.
• Use the App only for lawful purposes and comply with all applicable laws, including data protection and financial regulations.
• Be fully responsible for all activities that occur under your account.

5. Data Use and Privacy

Your use of LoanBase is also governed by our Privacy Policy, which details how we collect, use, store, and protect your personal data. We are committed to safeguarding your privacy and ensuring that your personal data is handled in accordance with the Privacy Policy and applicable laws.

6. Intellectual Property

All content, trademarks, logos, and intellectual property related to the LoanBase App are the exclusive property of COSTECH PRIDE TECHNOLOGY LIMITED. You may not copy, modify, distribute, or use any of our intellectual property without our prior written consent.

7. Loan Terms

Specific terms regarding loan amounts, interest rates, repayment schedules, and other loan conditions will be provided in your individual loan agreement. By applying for a loan, you agree to the terms outlined in that agreement.

8. Termination

We reserve the right to suspend or terminate your account and access to the App if you:

• Breach these Terms or any applicable laws;
• Provide false or misleading information;
• Engage in fraudulent or illegal activities.

You may also terminate your account at any time through the account closure process within the App.

9. Limitation of Liability

To the fullest extent permitted by law, LoanBase shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the App or services. Our liability is limited to the amount of the loan disbursed to you, if applicable.

10. Indemnification

You agree to indemnify, defend, and hold harmless COSTECH PRIDE TECHNOLOGY LIMITED, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the App or services;
• Your breach of these Terms or any applicable laws;
• Any third-party claims related to your actions or omissions.

11. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration conducted in Ghana, in accordance with the rules of the Ghana Arbitration Centre. You agree to waive any right to participate in a class action or representative action.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Ghana. Any legal actions or proceedings shall be subject to the exclusive jurisdiction of the courts of Ghana.

13. Changes to Terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. We will notify you of any material changes via the App or other appropriate communication channels. Your continued use of the App after such changes constitutes your acceptance of the updated Terms.

14. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and any loan agreements you enter into, constitute the entire agreement between you and COSTECH PRIDE TECHNOLOGY LIMITED regarding your use of the App and services.

16. Force Majeure

We shall not be liable for any failure to perform our obligations under these Terms due to events beyond our reasonable control, including but not limited to natural disasters, epidemics, wars, strikes, or government actions.
